Requires hospital and birth centers to request that maternity patients and fathers view a video presentation on the dangers of shaking infants and small children; requires such videos to be approved by the commissioner of health; such commissioner shall distribute appropriate training material and form for acknowledging viewing or refusing to view such video; requires inclusion of annual percentage of maternity patients who view the video in the information leaflet provided to maternity patients.

AN ACT to amend the public health law, in relation to establishing a
video on the dangers of shaking infants and young children to be
viewed by maternity patients and fathers of newborn children
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Paragraph (m) of subdivision 2 of section 2803-j of the public health law, as amended by chapter 62 of the laws of 1996, is amended and a new paragraph (n) is added to read as follows: (m) whether rooming-in is available in the facility, on the basis of twenty-four hours a day or daytime[.]; and (n) the annual percentage of maternity patients who view a shaken baby syndrome video presentation, approved by the commissioner pursuant to subdivision six of this section, prior to discharge.
§ 2. Section 2803-j of the public health law, as amended by chapter 62 of the laws of 1996, is amended by adding a new subdivision 6 to read as follows:
6. Every hospital and birth center shall request that each maternity patient and father of a newborn child, if available, view a video presentation, approved by the commissioner, on the dangers of shaking infants and young children, and the symptoms of shaken baby syndrome. After viewing such a video presentation or upon refusal to view such a video presentation, the hospital or birth center shall request that such patient and/or father sign a form stating that they have viewed or refused to view such video presentation. Such forms shall be submitted to the department on a quarterly basis. All training materials and forms required to implement the provisions of this subdivision shall be provided by the commissioner.
§ 3. This act shall take effect on the one hundred twentieth day after it shall have become a law, provided that: (a) section one of this act shall take effect January 1, 2006; and (b) any rules, regulations, forms and training materials necessary to implement the provisions of this act on its effective date are authorized and directed to be completed on or before such date.
